•The State talks about possible uses of BAREC to the City
of Santa Clara and the citizens, yet
the decision is up to the City.
There are conflicting statements.
–The State says they could use the land for “other
institutional uses,” yet
they say it is surplus land? Which is
it?
–The Mayor stated on April 26, 2005 at the City Council
Meeting:
•"The
reality is, the property is going to be
developed...
and there's nothing we can do
to stop
it. We can't withhold zoning arbitrarily,
unless
you want to subject this City to a
lawsuit
that will bankrupt it...and, it's just
not
going to happen, and I'm sorry to say,
that's
just the reality of it.“
–One year later ,the State representative Dan Potash
stated on April 13, 2006 at the
DTSC meeting:
•“…as a residential community it is the city of Santa
Clara that has final land
use authority.”
–Worth noting: There are State agencies interested in the
land (e.g., UC Santa Cruz,
GCRCD, SV Water District, etc.)
